General terms and conditions

The Luxy Qubino online store is managed by GOAP Računalniški inženiring in avtomatizacija procesov d.o.o. Nova Gorica, Ulica Klementa Juga 7, 5250 Solkan, registration number: 5414083000, Tax number: SI 62582950, hereinafter the Provider.

General terms and conditions of operations of the online store have been drawn up in accordance with the Consumer Protection Act (ZVPot), recommendations of the Chamber of Commerce and Industry of Slovenia and international e-commerce codes. We recommend that you read carefully the terms and conditions before using this website. By using this website, you express your approval of the stated conditions. Please do not use the online store, if you do not agree with the terms and conditions.

Upon the completion of the purchase or the correctly completed form for ordering the goods, each visitor to the online store also becomes a user or buyer.

The general terms and conditions address the operation of the online store, rights of users and the business relationship between the provider and the buyer.

Accessibility of information (summary of legislation)

The provider undertakes to always provide the buyer with the following information:

  a) Corporate identity (name and registered office, register number)

  b) Contact information enabling fast and effective communication (e-mail, telephone)

  c) Basic characteristics of goods or services (including after-sales services and guarantees)

  d) Availability of products (each product or service offered on the website should be available within a reasonable time)

  e) Conditions of delivery of the product or execution of the service (method, place and time of delivery)

  f) All prices must be clearly and unambiguously set and it must be clearly shown whether they already include taxes and transport costs

  g) Method of payment and delivery

  h) Time validity of the offer

  i) The period within which it is still possible to withdraw from the contract and conditions for withdrawal; in addition, also if and how much it costs the customer to return the product

  j) The complaint procedure must be clarified, including all details of the contact person or customer service  

Offer of items and prices

Due to the nature of online business, the offer and prices in the Luxy Qubino online store may be updated and amended. All prices in the online store are stated in EUR and include the value added tax (VAT). Prices are valid at the moment of placing an order and do not have a predetermined validity.  In the event that the price of the item changes during the processing of the order, the provider shall notify the buyer thereof. The provider shall use its best efforts to provide the buyer in any case with a lower price or offer an appropriate solution that would be mutually satisfactory.

Payment methods:

– Credit card: Visa, Mastercard and American Express

The provider shall, after delivery and payment of the ordered items, send an invoice to the buyer in pdf form to the buyer’s e-mail address. The invoice breaks down the price and all costs related to the purchase. Before placing the order, the buyer shall check the correctness of data.

The sales purchase agreement (order) in an electronic form is stored on the provider’s server. After successfully executed order, one copy of the agreement shall be sent to the buyer by e-mail.

Purchase procedure

  1. Add the selected product to the cart, then follow the simple purchase procedure. If you are buying for the first time and you have a problem, call us on 05 335 95 14 – we will be happy to help you. 
  2. Ordering and placing an order: After placing the order, the buyer receives an order confirmation by e-mail.
  3. Goods dispatched: The provider shall pack and dispatch the goods within the promised deadline.

Right of withdrawal from the purchase, return of goods

The buyer has the right to return the purchased goods within fourteen (14) days without any penalty. The costs incurred in returning the object of purchase shall be borne by the buyer. The buyer shall notify the provider in writing of the intended return, no later than within 8 days of the receipt of the goods, by e-mail, and return the goods within further 6 days. The products must be unused, undamaged, and in the original packaging. A copy of the invoice and all documentation belonging to the product must be attached. The provider shall return the entire purchase price no later than within 15 days of having received the returned goods. The provider shall not be obliged to accept any shipments that do not comply with the provider’s general terms and conditions.

Warranty

The items shall have a 2 year warranty. The warranty is valid subject to all installation instructions and upon submission of an invoice. 

Delivery

The provider shall deliver the goods or services within the promised time.

Communication

The provider may contact the user by means of remote communication only if the user does not explicitly object to this.

Advertising e-mails shall comprise of the following:

  • They shall be clearly and unambiguously marked as advertising messages.
  • The sender shall be clearly identified.
  • Various campaigns, promotions and other marketing techniques shall be marked as such. Conditions for participation shall also be clearly defined.
  • The provider shall explicitly respect the user’s wish not to receive advertising messages.

Limitation of liability

The provider shall to the best of its abilities strive to ensure that the information, published on its website, is up-to-date and correct. Nevertheless, the characteristics of the items, their availability and price may change so quickly that the provider fails to correct the information on the websites. In such an event the provider will notify the buyer of the amendments and allow him to cancel the order or replace the ordered item. All product photos are symbolic and do not guarantee the properties of the product.

Protection of personal data

The provider undertakes to carefully protect the client’s data from loss, misuse, unauthorized access or disclosure, alteration or destruction. The data shall be stored on password-protected and access restricted servers. Under no circumstances will the client’s data be passed on to a third party. Selection of membership in the provider’s e-mail list is optional. You can find it in the form for ordering goods in the online shopping cart.

By purchasing in the Luxy Qubino online store, the client allows GOAP d.o.o. as the controller of the personal data collection to use and process the submitted personal data in accordance with the provisions of the Personal Data Protection Act and for the purpose set out below.

The controller processes the user’s personal data, which the latter entered in the registration form: name, surname, address, postal code, place, telephone or GSM – optional, e-mail address.

The following data is also collected: data on purchases and accrued benefits: date of purchase, type of purchase, content of purchase, value of purchase, method of payment.

The provider will use the personal data for the purpose of fulfilling the order (execution of the transaction, invoicing, delivery of the product, everything related to the order) and other necessary communication related to the order.

The user may at any time, in writing or in another agreed manner (e.g. by e-mail) require that the personal data controller permanently or temporarily ceases to use his personal data for the purpose of direct marketing. The controller shall properly prevent the use of personal data for the purpose of direct marketing within 15 (fifteen) days and notify the user, who requested such notification, in writing (or by e-mail) within further 5 (five) days.

The transmitted personal data will be stored and used only for as long as necessary to achieve the purpose for which they were collected or processed.

By accepting these general terms and conditions, the user also confirms that he is aware of the right to inspect, transcribe, copy, supplement, correct, block and delete personal data related to him, in accordance with the provisions of the applicable act governing the protection of personal data.

Complaints and disputes

  • The provider complies with the applicable consumer protection legislation.
  • The provider shall establish an effective system for handling complaints and appoint a person who, in case of any problems, the buyer can contact by phone at 05 335 95 14 or by e-mail at [email protected] The buyer can submit a complaint by e-mail. 
  • The provider shall acknowledge the receipt of the complaint within five working days, inform the buyer how long it would take to deal with it and keep him informed of the progress of the procedure.
  • The provider is aware that the essential feature of a consumer dispute, at least as far as judicial settlement is concerned, is its disproportion between the economic value of the claim and the costs incurred in the settlement of the dispute. This is also the main obstacle for the consumer not to initiate a dispute in court. For this reason the provider shall use its best endeavours to resolve any possible disputes amicably.

Out-of-court settlement of consumer disputes

In accordance with the legal norms, GOAP d.o.o. does not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the consumer in accordance with the Out-of-Court Settlement of Consumer Disputes Act.

GOAP d.o.o., which as a provider of goods and services enables online trade in the territory of the Republic of Slovenia, publishes an electronic link to the online consumer dispute resolution platform (SRPS) on its website. The platform is available to the customer here:
